Bazonix (website: https://bazonix.com) is an online cryptocurrency exchange platform (hereinafter – the Trading Platform)

I. GENERAL PROVISIONS

  1. These Terms of Use, as well as any supplements, appendices, or documents expressly incorporated herein, constitute the complete agreement between users and Bazonix (together — the "Terms"). In the event of any conflict between the provisions of these Terms and the provisions of any other supplements or documents, the provisions of these Terms shall prevail. Any other information presented on the Trading Platform, or oral/written statements are not part of these Terms and have no legal force as an agreement between the parties.

  2. By accessing, viewing, or downloading information from the Trading Platform and using the Services provided by Bazonix, you confirm that you have read, understand, and agree to unconditionally comply with these Terms, as well as our Privacy Policy. Bazonix may, at any time without prior notice, make changes to the Terms. You agree to continue to comply with any such amended Terms, and that Bazonix is not obligated to notify you of such changes. You acknowledge that you are required to periodically check these Terms for changes, and that your continued use of the Trading Platform after the publication of any changes to the Terms indicates your acceptance of these changes.

  3. You do not acquire any rights to the Trading Platform, except for the rights to use the Trading Platform in accordance with these Terms, and you have no right to represent yourself as the owner of such rights.

  4. You are not permitted to use the Services or the Trading Platform if you are located, registered, or are a citizen or resident of the following countries: Afghanistan, American Samoa, U.S. Virgin Islands, Guam territory, Iran, Yemen, Canada, Cuba, Libya, Pakistan, State of Palestine, Puerto Rico, Somalia, Democratic People's Republic of Korea, Northern Mariana Islands, USA, Syria, as well as any other country subject to the UN Security Council sanctions list and its equivalent (hereinafter — "Prohibited Jurisdictions"). Bazonix may, at its discretion, monitor and restrict access to the Services or the Trading Platform in any of the Prohibited Jurisdictions and immediately refuse to provide services upon discovery of access from these jurisdictions.

II. DEFINITIONS

In these Terms:

  • "API" means application programming interfaces;
  • "Applicable Law" means civil and common law, laws, regulations, conventions, ordinances, directives, decisions, decrees, circulars, codes, orders, notices, demands, decrees, injunctions, resolutions, rules, and judgments of any governmental, quasi-governmental, legislative, administrative, or regulatory bodies, courts, agencies, or associations, the requirements of which You or Bazonix are obligated to comply with;
  • "Participant" - any user of the Trading Platform;
  • "Services" means websites, applications, and any services provided by Bazonix, including:
    1. Bazonix Trading Platform (website: https://bazonix.com);
    2. any downloadable material from Bazonix websites;
    3. any information, content, or other materials published or provided by Bazonix;
    4. any features, content, or services provided by any person that may be auxiliary to those mentioned above.
  • "Trading Platform" means an online cryptocurrency exchange platform hosted at: https://bazonix.com, as well as subdomains, APIs, and other information means belonging to Bazonix.

III. ACCESS CONDITIONS

  1. When accessing and using the Services, You must:

    1. not engage in activities associated with deriving income from illegal activities (including using cryptocurrency tumbler services, darknet markets, money laundering, or terrorism financing), and not post or distribute prohibited or illegal materials or information;
    2. not attempt to undermine the security or integrity of Bazonix's computing systems or networks;
    3. not use the Services in a way that may disrupt the provision of Services or the functioning of the Trading Platform;
    4. not attempt to gain unauthorized access to the computer system on which the Trading Platform is hosted;
    5. not transmit or input into the Trading Platform files that may damage computing devices or software of any other person;
    6. not attempt to modify, copy, adapt, reproduce, decompile, or reverse engineer any computer programs used to provide the Services;
    7. ensure the security and confidentiality of all usernames and passwords required to access the Trading Platform;
    8. immediately notify Bazonix of any breach of your security when using the Trading Platform.

  2. Use of the Services may be subject to restrictions, including transaction volumes and number of API calls. Any such restrictions will be communicated.

  3. By accessing the Trading Platform, You represent and warrant that:

    1. You agree to these Terms;
    2. You are at least 18 years old and have the right to assume obligations under these Terms;
    3. You are the legal owner of the funds you deposit into your Bazonix account, and these funds come from legitimate sources;
    4. Your use of the Services does not violate Applicable Law;
    5. You are aware of the risks associated with using the Services;
    6. The information you have provided is correct, authentic, and up-to-date;
    7. Any cryptocurrency withdrawal address you provide is your own, and you fully control this address;
    8. You have not violated Applicable Law and have not been subject to sanctions or penalties.

  4. Bazonix reserves the right to verify your identity in order to comply with Applicable Law.

  5. We may freeze any operation if we suspect a violation of the Terms. This may result in the cancellation of transactions you have made. We exclude compensation for any losses you would have incurred as a result of us closing your operations early. While your operation is frozen, we will conduct an investigation and may require your cooperation.

  6. We reserve the right to close your operations at any time at our discretion.

  7. You are responsible for providing us with correct data, including the withdrawal address. We are not responsible for your failure to receive cryptocurrency due to providing incorrect or outdated data.

IV. EXCHANGE OPERATIONS REGULATIONS

  1. If the exchange direction includes a floating rate, it is recalculated both when the cryptocurrency price falls and when it rises.

  2. Bazonix is not responsible and does not bear expenses for transaction delays on the client's side.

  3. The final rate fixation consists of two stages:

    1. upon reaching the necessary number of confirmations in the network required for crediting a particular cryptocurrency (these values are set individually for each exchange direction and correspond to the actual parameters for reflection on the balance);
    2. after the final stage of conversion of all funds received to the service account, which is carried out automatically or using special tools.

  4. The maximum time for final conversion and rate fixation after the first stage is no more than 10 minutes.

  5. The Bazonix online service is created to provide exchange operations and conversion of funds in various cryptocurrencies. When events occur related to a drop in exchange rates of more than 0.2%, protection against unprofitable operations is automatically activated, which may correspond to a change in the final price and its reduction in the online service up to 1.5% from the actual rate of reference exchanges.

  6. The user agrees that for large exchange amounts that may affect conversion and quotes, the payment may be made in an amount less than the amount that was initially calculated in the exchange request.

V. FEES

  1. You acknowledge and agree that fees are charged for the use of the Services.

  2. Bazonix may, at any time at its sole discretion, review and update the amount of fees. Any such changes regarding the amount of fees will be applied from the moment of implementation to any Services.

VI. PRIVACY POLICY

VII. REPRESENTATIONS AND WARRANTIES

  1. You represent and warrant that:

    1. You are authorized to access the Services and the Trading Platform;
    2. if you are using the Trading Platform on behalf of an organization, you have the necessary authority;
    3. you use the Trading Platform and Services at your own risk.

  2. You acknowledge and agree that:

    1. information provided on the Trading Platform is intended for general informational purposes only and may be incomplete or inaccurate;
    2. Bazonix does not guarantee that the use of the Trading Platform will be uninterrupted and error-free.

VIII. EXCHANGE CONDITIONS

  1. Bazonix does not own or control the underlying blockchain network software through which tokens are formed and transmitted.

  2. By using the Services, you acknowledge and agree that Bazonix is not responsible for the operation of such software and networks, and does not provide any guarantees regarding their functionality, security, or availability.

  3. Bazonix does not guarantee that all transactions will be conducted properly and is not responsible for losses incurred as a result of a transaction not being completed properly or in a timely manner.

  4. Bazonix is not responsible for notifying you of failed transactions. You are fully responsible for detecting and analyzing the failure of any transaction.

  5. Bazonix may adjust or cancel any transaction in which an error was made.

  6. The actual market rate during your transaction may differ from the specified rate depending on the trading speed. You agree that Bazonix is not responsible for rate fluctuations.

IX. TOKEN OWNERSHIP

  1. You confirm that any tokens used by you in connection with the Trading Platform belong to you or you are legally authorized to conduct transactions with them, and that all transactions are conducted by you, not on behalf of any other person.

X. COPYRIGHT AND INTELLECTUAL PROPERTY

  1. All materials, including logos, trademarks, images, designs, photographs, videos, and written materials that are displayed and used on the Site, are the intellectual property of Bazonix. The corporate identity and the Site as a whole are protected by copyright.

  2. Any intellectual property shown or used on the Site cannot be used without prior written permission from Bazonix.

  3. The names, titles, and logos of Bazonix cannot be used anywhere, including advertising, without prior written permission from Bazonix.

XI. LIMITATION OF LIABILITY

  1. Nothing in these Terms excludes or limits Bazonix's liability for:

    1. fraud;
    2. any other violations that cannot be excluded or limited in accordance with Applicable Law.

  2. Subject to the foregoing, to the maximum extent permitted by Applicable Law:

    1. under no circumstances shall Bazonix be liable for:
      1. indirect or incidental damages;
      2. lost profits, loss of business opportunities, loss of income or business reputation;
    2. Bazonix's aggregate liability is limited to the total amount of fees received from you in the last six months.

XII. CALCULATIONS

  1. All calculations made by the trading engine of the Trading Platform and verified by Bazonix are final. Bazonix does not guarantee uninterrupted and error-free use of the Trading Platform.

XIII. CONFIDENTIALITY

  1. You agree not to disclose Confidential Information that you may receive during the use of the Trading Platform.

  2. "Confidential Information" means any information that is confidential, a trade secret, or the property of Bazonix.

XIV. FORCE MAJEURE

  1. Neither party shall be liable for delay in performing obligations due to causes beyond its reasonable control, including natural disasters, wars, civil unrest, fires, floods, earthquakes, explosions, embargoes, terrorist attacks, power outages, and software problems.

XV. TERMINATION

  1. This agreement may be terminated by notice from Bazonix if you fail to comply with any of its terms.

  2. You may terminate this agreement with Bazonix at any time after completing all current transactions.

  3. Bazonix may, at its discretion, terminate your access to the Services, including limiting, suspending, or terminating the servicing of your exchanges.

XVI. SEVERABILITY

  1. If any provision of these Terms is found to be illegal, invalid, or unenforceable, that provision is considered independent of these Terms and does not affect the legality and validity of any other provisions.

XVII. APPLICABLE LAW AND JURISDICTION

  1. The interpretation, content, applicability, and legal force of the Terms are governed in accordance with the laws of the United Kingdom, and all disputes between the parties under this agreement shall be settled exclusively in the courts of the United Kingdom.

XVIII. COMMUNICATION

  1. You understand and agree that if Bazonix sends you messages by email, but you do not receive them due to an incorrect or outdated email address, or blocking of messages by your service provider or spam filter, or for any other reason, Bazonix will consider that the necessary messages have been sent to you.

XIX. FINAL PROVISIONS

  1. Bazonix has the right to unilaterally change the current conditions of the affiliate program.

  2. Any delay or refusal by Bazonix to exercise any of its rights should not prevent the company from exercising these rights in the future.
